These Terms of Service (“Terms”) govern your use of GAN Technologies Private Limited (“we”, “us”, “our”) — the Smart QR Ordering platform for shops, restaurants, and cafés in India. By registering a shop, signing in, or using any part of the service, you agree to these Terms.
If you do not agree, do not use the platform. You may stop using the service at any time.
1. What we provide
We provide software that lets merchants:
- Publish a digital menu customers open by scanning a QR code
- Receive and manage customer orders on the web dashboard and Vendor mobile app
- Offer UPI or pay-at-counter options (as configured by the shop)
- Send order updates or bill links via SMS, WhatsApp, or push notifications when those channels are enabled
- View basic sales reports and order history
We may add, change, or remove features. We try to keep the service available but do not guarantee uninterrupted access.
2. Who may use the service
- Shop owners and staff — You must be at least 18 years old and legally able to run a business in India. Information you provide during registration must be accurate.
- Customers — When you place an order through a shop’s QR menu, you are buying from that shop. We provide the ordering technology; the shop is responsible for fulfilment, pricing, quality, and refunds.
3. No separate vendor contract required
Shops may use the platform if they find it useful and may stop using it at any time. You do not need a signed paper contract with us. These Terms, together with our Privacy Policy, are the agreement between you and GAN Technologies Private Limited.
Stopping use means you no longer log in, remove QR codes, or ask us to disable your account. We may suspend or close accounts that violate these Terms or when a trial or subscription ends.
4. Shop accounts, trials, and subscriptions
- Registration requires a valid email or mobile number, shop details, and a secure password.
- New shops may receive a free trial period. After the trial, continued access may require a paid subscription.
- We may extend trials or adjust subscription dates for support or pilot programmes.
- You are responsible for keeping login credentials and any optional staff PIN confidential.
5. Shop owner responsibilities
As a shop using our platform, you agree to:
- Keep menu items, prices, stock status, and UPI details accurate
- Fulfil orders promptly and treat customers fairly
- Comply with applicable Indian laws for your business (including food safety, FSSAI, GST, and local licences where required)
- Obtain any customer consent needed for messages you send through SMS or WhatsApp
- Not use the platform for illegal, misleading, or harmful activity
6. Payments
- Customer payments are made to the shop’s UPI ID or at the shop’s counter, not to us as a wallet or payment bank.
- We do not hold customer money on behalf of shops unless explicitly stated in a future licensed payment integration.
- Payment status shown in the app (paid, pending, failed) depends on UPI apps, banks, and any payment webhook configured by the shop or platform.
- Disputes about food quality, wrong orders, or refunds are between the customer and the shop.
7. Customer orders
When a customer places an order:
- They provide a mobile number (and optionally a name) so the shop can prepare and notify them.
- Order details are shared with the shop that received the order.
- Customers should verify items and totals before paying.
8. Acceptable use
You must not:
- Attempt to access another shop’s data or admin area without permission
- Upload unlawful, offensive, or infringing content (images, menu text, etc.)
- Overload, scrape, or reverse-engineer the service
- Misrepresent your identity or shop
9. Your content and our software
- You keep ownership of your shop name, logo, menu text, and product images. You grant us a limited licence to host and display that content so the service works.
- Our software, branding, QR flows, and documentation remain our property. You may not copy or resell the platform.
10. Privacy
Our Privacy Policy explains how we collect and use personal data, including customer phone numbers and order information. It forms part of these Terms.
11. Disclaimers
The service is provided on an “as is” and “as available” basis to the extent permitted by Indian law. We do not warrant that the service will be error-free or that every notification will be delivered (SMS, WhatsApp, and push depend on third-party networks).
12. Limitation of liability
To the maximum extent permitted by law, GAN Technologies Private Limited is not liable for indirect, incidental, or consequential damages, lost profits, or loss of data arising from use of the service. Our total liability for any claim relating to the service is limited to the subscription fees you paid us in the three (3) months before the claim, or ₹5,000, whichever is greater.
Nothing in these Terms limits liability that cannot be limited under Indian law.
13. Suspension and termination
We may suspend or terminate access if you breach these Terms, if required by law, or if your subscription or trial ends. You may request account deletion through the Vendor app API or by contacting us. After termination, we may retain certain records as described in our Privacy Policy.
14. Changes to these Terms
We may update these Terms from time to time. The “Effective” date at the top will change when we do. Continued use after changes means you accept the updated Terms. Material changes may also be shown in the app or on the website.
15. Governing law and disputes
These Terms are governed by the laws of India. Courts in Hyderabad, Telangana shall have exclusive jurisdiction, subject to applicable consumer protection laws.
